This Privacy Policy explains how the Uplevel enterprise collects, uses, shares, and protects your personal information, and the choices and rights you have. It is published by Uplevel By Design, LLC and covers the four Uplevel entities: Uplevel By Design, LLC; Uplevel Entrepreneur, LLC; Your Books By Design, LLC; and Collins Lambert, LLC (together, the “Uplevel entities,” “we,” “us,” or “our”).
It applies to you whether you are a Member (in a Coaching & Consulting Program), a Client (engaging a Done-For-You Service), a prospective Member or Client, a website visitor, or another individual whose personal information we handle (“you”). It is posted at uplevelbydesign.com and provided to Members and Clients at engagement. For Members and Clients, it complements the Uplevel Master Member & Client Agreement, the AI Use Disclosure and Consent Addendum, and the Cross-Affiliate Information Sharing Authorization.
Our standard. Privacy laws differ from state to state. Rather than apply only the minimum a given law requires, we extend the most protective standard among applicable U.S. state privacy laws to everyone we serve, and we fill any additional requirement a particular state imposes. Where a right or protection described below exceeds what a specific law requires of us, we provide it as a matter of policy.
1. The Uplevel Entities And The Advisory Carve-Out
- Uplevel By Design, LLC … Parent and master brand; publishes this Policy and orchestrates the integrated experience.
- Uplevel Entrepreneur, LLC … Coaching, consulting, and strategic education (Member engagements).
- Your Books By Design, LLC … Tax preparation, bookkeeping, and Fractional CFO services (Client engagements).
- Collins Lambert, LLC … Professional asset management (through Investment Adviser Representatives of LPL Financial LLC’s corporate Registered Investment Adviser) and insurance placement (Client engagements).
Advisory carve-out. Personal information handled in investment advisory work conducted by the Investment Adviser Representatives of LPL Financial LLC’s corporate Registered Investment Adviser (under the Collins Lambert, LLC name) is governed by LPL Financial’s privacy notice and Regulation S-P framework, not by this Policy.
2. How The Privacy Rules Fit Together
Two sets of rules apply to the information we handle, and we honor both:
- Financial privacy (the Gramm-Leach-Bliley Act, “GLBA”). Nonpublic personal information you provide for financial services, especially tax preparation, bookkeeping, and Fractional CFO services through Your Books By Design, LLC, is “financial information” protected under the GLBA. Section 6 describes how we handle it.
- State consumer-privacy rights. Other personal information we handle (for example, information collected through our website, marketing, and Coaching & Consulting Programs) is subject to state consumer-privacy laws. Section 7 describes the rights we extend, applying the most protective standard.
Some information is governed by both; where that is so, we apply the protections of each.
3. Personal Information We Collect
Depending on your relationship with us, we may collect:
- Identifiers and contact information … name, address, email, phone, and similar identifiers.
- Financial, tax, and account information … income, assets, liabilities, tax documents, financial statements, and account information you provide for services (nonpublic personal information under the GLBA).
- Business and entity information … entity formation, ownership, governance, and operating information.
- Planning information … goals, circumstances, and other information used to design and coordinate your strategy.
- Communications … your messages, meeting recordings and transcripts, and related records.
- Online and device information … information collected automatically when you use our website, such as IP address, device and browser data, and usage information collected through cookies and similar technologies.
We collect this information from you, from your authorized advisors and representatives, from the Uplevel entities providing your services, and from our service providers and our website.
4. How We Use Your Information
We use your personal information to deliver and coordinate the services you engage; prepare your deliverables; operate, maintain, secure, and improve our services and website; communicate with you; and comply with our legal, tax, and regulatory obligations. We do not use your information for purposes incompatible with those described here without your consent.
5. How And With Whom We Share
- Among the Uplevel entities … to provide the coordinated, integrated experience, as detailed in the Cross-Affiliate Information Sharing Authorization.
- Service providers and processors … vendors who perform services for us under contract and confidentiality obligations, including the approved artificial-intelligence vendors described in the AI Use Disclosure and Consent Addendum.
- Your designated advisors … your attorney, CPA, or other professionals, where you direct or authorize it.
- Legal and safety … where required by law or valid legal process, or to protect rights, property, or safety.
We do not sell your personal information, and we do not share it for cross-context behavioral (targeted) advertising. The sharing of “tax return information” by Your Books By Design, LLC is governed by the separate Internal Revenue Code Section 7216 consents; advisory-side data is governed by LPL Financial’s framework (Section 1).
6. GLBA Financial Privacy
For the nonpublic personal information you provide for financial services:
- We collect it from you and from the sources described in Section 3, and use it to provide and coordinate those services.
- We share it among the Uplevel entities to provide coordinated services, and with service providers as permitted by the GLBA, under confidentiality obligations.
- We do not disclose your nonpublic personal information to nonaffiliated third parties except as permitted or required by law, and not for their own marketing.
- It is protected under Your Books By Design, LLC’s Written Information Security Program, maintained to conform to Internal Revenue Service Publications 4557 and 5708 and the Federal Trade Commission Safeguards Rule (16 C.F.R. Part 314).
7. Your Privacy Rights
We extend the following rights to all individuals we serve, regardless of state, applying the most protective standard among applicable laws:
- Know and access … to learn what personal information we collect, use, and disclose, and to receive a copy in a portable format.
- Correct … to correct inaccurate personal information.
- Delete … to request deletion of your personal information.
- Opt out … of any sale of personal information, of targeted advertising, and of profiling that produces legal or similarly significant effects. We honor recognized universal opt-out signals, such as the Global Privacy Control, sent by your browser.
- Sensitive information … we obtain your opt-in consent before processing sensitive personal information, and we honor your right to limit its use and disclosure.
- Appeal … if we decline a request, you may appeal; we will respond to the appeal in writing.
- Non-discrimination … we will not discriminate or retaliate against you for exercising any of these rights.
How to exercise. Contact us using Section 13. We will verify your request as required and respond within 45 days, extending the period and notifying you where permitted. An authorized agent may submit a request on your behalf with proof of authority.
Nonpublic personal information governed by the GLBA (Section 6) and advisory data governed by LPL Financial’s framework (Section 1) are handled under those frameworks; the rights above apply to other personal information we hold.
8. California Notice (CCPA / CPRA)
If you are a California resident, the following applies in addition to Section 7. Over the preceding 12 months, we have collected the categories of personal information described in Section 3 (including identifiers, financial information, commercial information, internet/usage activity, and professional information), from the sources and for the business and commercial purposes described in this Policy, and we may disclose those categories to the recipients described in Section 5.
- We do not sell or share your personal information as those terms are defined under the CCPA/CPRA.
- Sensitive personal information … we use it only for permitted purposes and obtain your consent as described in Section 7; we do not use it to infer characteristics.
- GLBA data … personal information collected and processed under the GLBA is exempt from the CCPA/CPRA and is handled under Section 6.
- You have the CCPA/CPRA rights to know, access, correct, delete, and limit, as reflected in Section 7, and the right to be free from discrimination for exercising them. An authorized agent may act for you.
9. Data Security
We maintain administrative, technical, and physical safeguards appropriate to the sensitivity of the information we handle, including access controls, encryption where supported, and vendor due diligence. Tax and financial information held by Your Books By Design, LLC is protected under its Written Information Security Program (Section 6); advisory data is protected under LPL Financial’s Regulation S-P framework; and approved AI-vendor handling is governed by the AI Use Disclosure and Consent Addendum. We notify affected individuals and authorities of security incidents as required by applicable law.
10. Data Retention
We retain your personal information for as long as needed to provide your services and for the legitimate and legal purposes described in this Policy, and thereafter as required by applicable legal, tax, and regulatory retention obligations (for example, tax records retained per Internal Revenue Service and state requirements). When information is no longer needed, we delete or de-identify it.
11. Children’s Privacy
Our services are directed to adults. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will delete it.
12. Changes To This Policy; Effective Date
This Policy is effective as of the Effective Date below and is reviewed at least annually. We may update it to reflect changes in our practices or the law. We will post the updated Policy with a new effective date and, for Members and Clients, communicate material changes by email, in-platform notification, or comparable means.
